Article 11 – Right of Withdrawal and Returns

In accordance with the provisions of Article L 121-16-1 of the French Consumer Code, the customer does not have a right of withdrawal due to their status as a professional as defined by the Consumer Code.

All returns must be expressly accepted by www.prestila.com, except in the case of defective or non-conforming goods. In this case, the customer has 10 days from receipt of the package to request a return. The costs and risks of the return are borne by the buyer.

*Plus sizes and custom orders that we offer for sale are not eligible for the right of withdrawal.

Any return accepted by www.prestila.com will result in the issuance of a credit note to the buyer after a quality and quantity check of the returned goods. Any merchandise returned without prior agreement from www.prestila.com will be made available to the buyer and no credit will be issued.

When returning items, we recommend that you over-pack the original packaging of your products, as we can only accept products returned complete, in their original packaging. All items must be intact and in good condition.

You must include a copy of the invoice with your return.

Refunds or exchanges are contingent upon the product not being damaged or returned incomplete.

For all exceptional orders, the right of withdrawal does not apply.

Article 12 - RETENTION OF TITLE CLAUSE

www.prestila.com retains full ownership of the goods sold until full payment of the price, including principal and any additional charges, in accordance with the law of May 12, 1980.

Under this clause, if the buyer is subject to receivership or liquidation proceedings, www.prestila.com (SARL Prestila) reserves the right to claim, within the framework of the collective procedure, the goods sold and remaining unpaid

Article 13: FORCE MAJEURE

www.prestila.com shall not be held liable for any failure to perform or delay in any of its obligations under these terms and conditions of sale if such failure or delay is due to force majeure.

For the purposes of this clause, force majeure shall be understood to mean any external, unforeseeable, and irresistible event, as defined in Article 1148 of the French Civil Code, including but not limited to strikes, war, riots, shortages, and political events, whether occurring in France or in the country of origin and/or transit of the goods ordered.

Article 14 – Confidentiality

The Seller takes all necessary measures to ensure the confidentiality and security of data transmitted online. To this end, the website uses a secure payment module.

Article 15: Data Protection and Privacy

In accordance with Law 78-17 of January 6, 1978, it is noted that the personal data requested from the Customer is necessary for processing their order and is intended for internal use only.

You have the right to access, modify, rectify, and delete your personal data at any time (Article 34 of the French Data Protection Act). The information you provide is necessary for processing your order and for our business relationship. Article 16: Intellectual Property

All intellectual property rights, including but not limited to trademarks, copyrights, and designs, covering the goods sold by www.prestila.com and owned by the latter, remain its exclusive property. The buyer may only use these rights for the purpose of reselling the goods.

This website and these legal notices may be modified or corrected at any time without prior notice.

Article 17: Custom Orders

The shop accepts custom orders (subject to design approval). Quantity, quality, and color must be specified at the time of ordering. There is no right of withdrawal for custom orders.

The shop offers custom sizing, which is already specified in the product description. We do not offer refunds or exchanges for errors in design, size, or color. Please check your order before confirming it.

Article 18: GOVERNING LAW AND JURISDICTION

Any dispute relating to the interpretation and execution of these terms and conditions of sale shall be governed by French law. The parties expressly agree to exclude the application of the Vienna Convention of April 11, 1980.
